Dissolution of marriage is a termination of a marriage by agreement. The parties file a joint petition with the court, requesting the court to approve the separation agreement. It is a great way to keep costs low, however it is not always the best option in every situation. A divorce should be pursued instead of a dissolution, if:
1. A party needs immediate relief from the court;
2. A party is absent from the jurisdiction and unable to negotiate or a party is unwilling to negotiate;
3. There is concern a party may be hiding assets; AND
4. Certain custody issues or concerns are present.
A divorce is required when there are custody issues or concerns regarding a party's threat to remove children from the court's jurisdiction, withholding visitation, or threatening to harm the party or the party's children.
